GENERAL CONDITIONS OF USE AND SALE

The Terms and Conditions apply to all orders placed on or after the date of the last update above. For orders placed before that date, visit the previous versions and consider the version in effect at the time of your order.
Amevista Srl ("Amevista") and/or its foreign branches, if any, provide Site functionality and other products and services to you when you visit or shop at Amevista.co.uk (the "Site"), use Amevista devices, products or services, Amevista mobile applications or software provided by Amevista in connection with any of the foregoing activities (collectively, the "Amevista Services"). We encourage you to review our Privacy Policy, our Cookie Policy, to understand how we collect and process your personal information through the Amevista Services. Amevista provides the Amevista Services under the following terms and conditions ("Terms and Conditions of Use and Sale").

(I) GENERAL CONDITIONS OF USE
Please read these terms and conditions ("General Terms of Use") carefully before using the Amevista Services. By using the Amevista Services you fully accept these General Terms and Conditions of Use. Because there are various Amevista Services, you may sometimes be subject to different and/or additional terms and conditions. When using an Amevista Service (for example: The Personal Area, Gift Certificates, or Amevista mobile applications), you will also be subject to the general terms, guidelines, and conditions applicable to that particular Amevista Service ("Terms of Service"). In the event of any conflict between these Terms of Use and the Terms of Service, the Terms of Service will prevail.
1. MODE OF COMMUNICATION
1.1 When you use the Amevista Services you receive or send e-mails, text messages (SMS) and other communications from your computer or mobile device, you are communicating with us electronically.
1.2 Amevista may communicate with you in a variety of ways, such as through email, text messaging (SMS), in-app notifications, or by posting messages and communications on the Site or through other Amevista Services.
1.3 Subject to specific statutory provisions of an unwaivable nature, for the purposes of this contract, you agree that all contracts, notices, disclosures, and other communications that we provide in electronic form satisfy the requirement that they be in writing and may be printed in paper form when required by law.
2. PERSONAL AREA
2.1 You may need your Amevista account ("Personal Area") to use certain Amevista Services and be required to access your Personal Area as well as have a valid payment method associated with it.
2.2 If there is a problem with charging to your selected payment method, we may charge to any other valid payment method you have associated with your Personal Area. Access the corresponding page to manage your payment options.
2.3 If you use the Amevista Services, you must keep your Personal Area and password confidential and control access to your computer and devices, because you are responsible for all activities that will be performed through your Personal Area and password. You therefore agree to take all precautions to ensure that your password remains secure and confidential and to notify us immediately if you have reason to believe that any third party has knowledge of your password, or if your password is, or allegedly is about to be, used in an unauthorized manner. You will also be able to access your information from the My Personal Area section of the application to change the information you have previously provided. Please see our appropriate pages on how to protect your privacy to access your personal information.
2.4 It is prohibited to use the Amevista Services for fraudulent purposes, or otherwise to commit illegal activities, or to generate Site malfunctions and/or problems and damage to Amevista's business.
2.5 We reserve the right to terminate your Amevista Personal Area and/or restrict your access to and use of the Amevista Services if you violate applicable law, these Terms of Use and Terms of Service, our Terms of Service, our guidelines, or our policies, all of which are accessible on our site.
2.6 We will notify you in writing by email of the termination of your Amevista Personal Area or the restriction of your access to and use of the Amevista Services.
2.7 You can close your Amevista accounts at any time by accessing the "My Personal Area" page.
3. OWNERSHIP AND USE OF INTANGIBLE RIGHTS
3.1 All content featured in or made available through the Amevista Services in the form of text, graphics, logos, icon buttons, images, audio files, digital downloads, data collections, and software, is the property of Amevista or its product and content providers and is protected by copyright and database rights laws.
3.2 You may not extract, download and/or use for any purpose other than the Site's own purposes any portion of the Amevista Services without the express written consent of Amevista, or create and/or publish your own database that reproduces substantial portions (e.g., prices and product listings) of the Amevista Services without the express written consent of Amevista.
3.3 Trademarks appearing on any of the Amevista Services or on products sold by Amevista are the property of their respective owners, who may or may not be related to, connected with, sponsoring, or sponsored by Amevista.
3.4 Subject to your compliance with these Terms of Use, the Terms of Service, and payment of any applicable fees, Amevista or its content provider grants you a limited, temporary, non-exclusive, non-transferable license to access and make personal, non-commercial use of the Amevista Services. This license does not grant you any right of resale or commercial use of each of the Amevista Services or its contents, nor does it grant you the right to collect and use lists, descriptions, product sheets, listings or prices of products, make derivative use of the Amevista Services or their contents, make any kind of downloading or copying of information and content from the Site for the benefit of another reseller, or use data mining, robots or similar data acquisition and extraction devices. All rights not expressly conferred by these Terms of Use or the Terms of Service remain with Amevista or its licensors and suppliers of goods and services.
3.5 You may not reproduce, copy, sell or use for any commercial use the Amevista Services in whole or in part without the written consent of Amevista. It is prohibited to appropriate by any means any trademark, logo, or other proprietary information (including images, text, page settings, or format) of Amevista without express written consent.
3.6 Violation of these Terms of Use or the Terms of Service will result in both material and moral damages in favor of Amevista.
4. REVIEWS
4.1 It is permissible to post reviews and other content, send communications, and submit suggestions, ideas, comments, questions, or other information, as long as the content is not unlawful. By way of example, content that is intimidating, defamatory, infringes on the privacy, intellectual property rights of Amevista or third parties, or is otherwise offensive to Amevista and/or third parties or deplorable or contains viruses, political propaganda, commercial solicitations, chain letters, mass emails, or any other form of spamming is unlawful.
4.2 Using a false e-mail address, pretending to be another person or subject, or otherwise lying is prohibited.
4.3 We reserve the right to remove or edit unlawful or prohibited content, subject to any right of Amevista to compensation under Section 3.6 above.
4.4 If you believe that any content, or a sales advertisement posted on the Site or used as part of the Amevista Services, contains a defamatory statement or that any of your intellectual property rights have been infringed by any article or information on the Site or used as part of the Amevista Services, please send us appropriate notice through the Customer Service function and we will promptly take appropriate action.
4.5 If you decide to post customer reviews, comments, customer questions or answers, or submit other video or sound content of your own created by you for display on the Site, you grant Amevista a royalty-free license to use, reproduce, publish, make available, translate, and modify such content anywhere in the world (including the right to sub-license to third parties) and the right to use the name you use in connection with such content.
4.6 You can delete your content from being displayed on our Site at any time.
4.7 You represent and warrant that you have the availability and/or possession of all rights to the content of what you post; that as of the date the content or material is posted the content is relevant; and that such use does not cause damage or harm to Amevista or any third party. You therefore agree to indemnify and hold Amevista harmless from all legal actions taken by third parties against Amevista arising out of or otherwise inherent in and related to the content you post.
5. RESTRICTIONS ON EXPORTS OF PURCHASED PRODUCTS
5.1 You are prohibited from exporting, re-exporting, or transferring any product you have purchased on the Site to any state, individual, company, organization, or entity to which such export is restricted or prohibited by law. You therefore agree, for example, that economic sanctions and embargoes imposed by the European Union, the United Nations, and other governmental authorities (such as embargoes imposed on specific countries, or economic sanctions imposed on individuals or companies for crimes of terrorism or money laundering) may prohibit you from taking or sending products, including for personal use, to other countries, and/or from sending or taking products to certain individuals, companies, organizations, or entities. Furthermore, you agree not to purchase any products or services from the site if you yourself are subject to restrictive measures (sanctions).
6. UNDER 18 YEARS OF AGE
6.1 We do not sell products to children under the age of 18. We sell children's products that can only be purchased by adults. If you are under the age of 18, you may use the Amevista Services only through a parent or guardian.
7. NOTIFICATION AND PROCEDURE FOR REPORTING ILLEGAL CONTENT
7.1 If you believe that your intellectual property rights have been infringed, please send your report to Customer Service. You may report alleged infringement of all intellectual property rights, including without limitation, reports regarding trademark, design, and patent.
7.2 Once we receive a report we can take several actions. For example, we may remove information from an item or article. Our actions are taken without admission of liability and without prejudice to any of our rights, remedies or defenses, which we expressly reserve. This includes sending the report to the individuals involved in the preparation of the content found to be unlawful. You agree to hold Amevista harmless from all third-party actions against Amevista arising out of or related to the submission of a report.
7.3 If you wish to otherwise report issues related to products, content, or a product page to us, for example because you believe the product or content is illegal, you may submit a report through Customer Service. Providing false, misleading, or inaccurate information in your report may result in civil and/or criminal liability. If you have any questions, please consult an attorney.
7.4 The product sheets of our suppliers are only stored on the Site and are published only as directed by our suppliers.
8. OUR TASKS
8.1 As part of the Amevista Services, if authorized, we will recommend features, products and services, including third-party advertisements that may be of interest to you and, in addition, identify your preferences and personalize your experience.
8.2 It is our responsibility to ensure that access to the Amevista Services is provided without interruption and that transmissions occur without error. However, due to the nature of the Internet, uninterrupted access and error-free transmission cannot be guaranteed. In addition, your access to the Amevista Services may also be occasionally suspended or restricted to allow for repair work, maintenance, or the introduction of new activities or services.
9. LIMITS TO LIABILITY
9.1 In the event of any breach by you of the General Terms and Conditions of Use and Sale, our failure to exercise our right of action against you does not constitute our acquiescence and/or waiver of action for breach of your obligations.
9.2 Amevista shall not be liable for any loss or damage that is not a direct result of a breach of these Terms and Conditions, nor for any loss of business opportunity (including without limitation lost revenues, contracts, deemed savings, goodwill or unnecessarily incurred expenses) or for any other indirect or consequential loss that is not reasonably foreseeable.
9.3 Furthermore, Amevista shall never be liable for any delay or non-performance of its obligations under the General Conditions of Use and Sale if the delay or non-performance arises from unforeseeable circumstances or from force majeure. This provision shall not affect your rights under the law and in particular your right to receive the purchased goods within a reasonable period of time or to be reimbursed in the event of non-delivery due to circumstances arising from fortuitous circumstances or force majeure.
9.4 Please be advised that the laws of some states may reduce and/or prohibit the limitations of liability now set forth. In the event that such regulations are found to be applicable, the reductions and/or limitations of liability now indicated shall not take effect and you may be entitled to your rights under these regulations.
10. CHANGES TO THE GENERAL CONDITIONS OF USE
10.1 We reserve the right to modify these General Terms of Use, our guidelines and policies at any time, to conform to legal and regulatory requirements, to make them clearer or easier to understand, to reflect any changes to the Amevista Services, or for any other reason, by posting the updated version on Amevista.co.uk or on any other site or application used to provide the Amevista Services. In the event that a material change is made to these Terms of Use, you will be notified prior to your use of the Amevista Services.
10.2 The General Terms of Use, Guidelines and our policies are those in effect at the time you use the Amevista Services. You may discontinue use of any Amevista Services, close Your Amevista Personal Area, or cancel the related Amevista Services at any time and for any reason, including when changes are made.
10.3 Should any provision of these conditions be held invalid, void, or for any reason unenforceable, this shall not affect the validity and enforceability of the other provisions.

12. APPLICABLE LAW AND PLACE OF JURISDICTION
12.1 These General Terms of Use are governed by and shall be enforced in accordance with the laws of Italy.
12.2 Unless otherwise desired by the user of Amevista's services who may decide to take advantage of paragraph 12.1 above:
(a) if the consumer user is a resident of the EU, the applicable law is that of his or her country of residence and, therefore, the rules of the General Conditions of Use, which are not in line with the applicable law in the customer's country of residence, are to be considered supplemented and/or replaced by the mandatory and non-derogable rules in force in the country of residence of the user.
(b) if the user is a resident outside the EU, and there are no international treaties, conventions or agreements that, for the use of Amevista services assimilate his or her Sate of residence to an EU country, the applicable law is as set forth in paragraph 12.1 above.
12.3 In the event of a dispute between Amevista and the users of the Amevista Services, the jurisdiction of the Italian Courts and Tribunals shall apply, unless a mandatory and non-derogable rule, applicable to the user of the Amevista Services, provides for the latter the possibility to act before Courts and Tribunals other than the Italian Courts and Tribunals to enforce its rights.
(II) GENERAL CONDITIONS OF SALE
Background
The company Amevista Srl, Via Flaminia 844 - 00191 Rome - P. IVA 14956881008 (hereinafter referred to as "Amevista" or "Amevista.com"), operates through the website (hereinafter referred to as "Site") an online store.
For all orders placed through the Site (and language subdomains) as well as for all sales and services incidental to sales, the following general terms and conditions apply exclusively.
By submitting an order, the customer agrees not to use the ophthalmic lenses and/or contact lenses before having read and fully understood the guide to their proper use, as well as the warnings, precautions and risks associated with their use as described in the packages purchased. The customer for any questions, consultation and, where necessary, examination of ophthalmic or contact lenses, can contact one of our specialists in the "Assistance" section.
By submitting the order, the customer:
- states that he is over 18 years old;
- declares that he or she has undergone the periodic checkups scheduled by his or her ophthalmologist and optometrist, each for their respective areas and expertise.
- states that he or she has previously consulted an ophthalmologist regarding the suitability and compatibility of the product ordered;
- states that the product ordered corresponds to the prescription of their ophthalmologist;
- releases Amevista from any liability associated with the purchase of an unsuitable product;
1. OBJECT AND CONCLUSION OF THE CONTRACT
1.1 The languages available for reading and concluding the contract depend on the selection of the destination country and are indicated below:
1.2 The object of the contract is the purchase and sale of products whose description and price are indicated on the Site. The indication of products and services on the Site or through Amevista's mobile applications not constitutes a binding proposal by Amevista, but merely an invitation to users to make a purchase proposal.
1.3 All orders placed on the Site must correspond to normal consumption needs. This requirement applies both in relation to the number of products purchased with a single order and in the case of multiple orders for the same product.
1.4 If the user wishes to purchase one or more products, he may select them one at a time and add them to his shopping cart. Once he or she has selected all the items he or she wishes to purchase, he or she may close his or her shopping cart and place the order. At this point a page will appear summarizing the selected products, their price, and the options (with their costs) for delivery. At that point you will be prompted to choose your preferred delivery, transportation, and payment method. Before the order is sent, the customer displays a summary containing all the data he has entered and the possibility to correct any errors.
1.5 On the same page, a special "Proceed to Order" button is highlighted, which must be clicked to place the order, which can also be placed with payment by "Express Checkout." The order shall be considered as a concrete and binding contractual proposal addressed to Amevista for the purchase of the products listed at the price indicated, each considered individually. Upon receipt of your order, we will automatically send you an e-mail message informing you that we have taken your order ("Order Confirmation") and summarizing the details of your order with the option to change your shipping address within 30 minutes of order confirmation.
1.6 The Order Confirmation does not constitute acceptance of the purchase proposal, but merely confirmation that we have received the order and subjected it to our data verification process and availability of the requested products. The sales contract with Amevista will be concluded only when we ship the products, such shipment constituting tacit acceptance of the customer's purchase proposal. Should such shipment not occur due to Amevista not having accepted the order, the advance payment will be returned to the customer. You may cancel your order before having received the Order Confirmation, provided that it is not a purchase of customized products and that the order has not been prepared for shipment. In this case, you will not be charged. However, this is without prejudice to your right to cancel on the terms and conditions set forth in this contract.
1.7 The data concerning the order are stored. Should the customer request a copy of the order, he/she may print out the "Confirmation of Receipt of Order" that appears on the screen after transmitting the order to us by clicking on the "Confirm Order" button and after successful verification of payment.
1.8 An invoice will be issued for each concluded contract, which the customer agrees to receive in electronic format. The invoice is also available in PDF format within the "Personal Area" section of the application. The issuance of an electronic invoice for an order will be communicated in the Order Confirmation.
2. PRICES, PRODUCTS, AVAILABILITY, GIFT CARDS AND PROMO CODES
2.1 All prices are inclusive of VAT, tariffs and duties where applicable, at the rates prescribed by law, as well as any customs clearance fees as indicated at the time of order on our Site. Any shipping charges are indicated in the shopping cart in the specific section.
2.2 The products offered on the Site comply with EEC regulations, contact lenses comply with the provisions and basic safety requirements imposed on the manufacturer by Directives 93/42/EEC, 90/385/EEC and 98/79/EEC on medical devices, guaranteeing the originality of the original products. All products are presented using digital photographs of actual products (small variations between these photographs and reality do not constitute conformity defects). Products are not manipulated in any way by Amevista and are shipped with original labels and packaging (if available, certificates of originality are also sent). Products can be customized according to the buyer's specifications . Custom applied lenses are Italian-made, of the highest quality, technologically advanced, but do not bear the logo or trademark of the eyewear manufacturer. Together with the customized product, Amevista also supplies the original lenses if the product purchased and requested to be customized has them.
2.3 Information about the availability of the products we sell is specified on the Site, as well as on the presentation page for each product. Other than the information provided on that page or elsewhere on the Site, we are unable to give more precise information regarding the availability of products.
2.4 Gift Card (hereinafter referred to as "Card" or "Gift Card")
- The Card is valid for the purchase of items for sale on the Site. During the purchase process, the recipient must enter the code associated with the Card in the shopping cart.
- The Card may be purchased using the payment methods accepted on the Site. The Card may not be purchased using another Gift Card. No invoice will be issued for the purchase of the Card; an invoice will be issued when the Card is used for the order.
- The Card may be used in one lump sum for purchases equal to or greater than the value of the Card.
- Where applicable, the refund of the price of goods purchased through the use of the Card and returned without replacement will be made through a Voucher that will be sent via e-mail to the address provided by the customer who made the purchase using the Card. The Voucher will be subject to these terms and conditions, to the extent applicable.
- The Card is valid for 1 year from the date of purchase of the Gift Card. When the validity expires, the Card cannot be renewed or used to purchase goods, and the remaining value of the Card cannot be refunded or converted to cash.
- The Card is not registered and may be used by anyone who presents it to purchase goods on the Site. The Card holder is solely responsible for the use and safekeeping of the Card.
- For virtual Cards purchased, Amevista shall not be liable for the non-receipt or delay in the receipt of said virtual Card by the recipient due to causes of force majeure and otherwise not attributable in any way and to the fullest extent permitted by applicable law to Amevista such as, but not limited to: (i) the inaccuracy of the virtual Card recipient's data provided by the purchaser of said Card, (ii) the circumstance that the e-mail sent by Amevista is considered as spam or junk mail in the recipient's mailbox.
- Cards obtained by any fraudulent or illegal means will be considered void and unusable, may not be used to purchase goods, and the price for the purchase may not be refunded. Amevista reserves the right to cancel or suspend the Card in case of alleged fraud.
- The Card may not be used for advertising purposes or to promote marketed products or services by third parties unrelated to Amevista, except with prior written permission.
- The purchase and/or use of the Card implies full acceptance of these terms and conditions, which were made available to the customer at the time of purchase of the Card.
- The Card is merely a payment instrument and does not constitute an anticipation of the transfer of the asset to which Card entitles, is not a security representing assets, and is not intended in any way as a means of investment and/or solicitation of savings.
3. GUARANTEES OF LIABILITY AND WAIVER OF ACTION
3.1 Amevista guarantees full traceability of the purchase of all products it sells and certifies the exclusive origin of the same directly from the producers and official suppliers.
3.2 If you purchase as a "consumer," you benefit from the legal warranty of conformity to which Amevista as seller is required by law on every good sold ("Legal Warranty").
3.3 The Legal Warranty guarantees the goods against defects in conformity with the contract of sale.
3.4 In case you find a conformity defect on the goods purchased from Amevista during the validity period of the Legal Warranty, please contact the "Support" service through the relevant function.
3.5 In case of defects and consequent applicability of the Legal Warranty, Amevista is obliged to repair or replace the product, or, if this is not possible, to a reduction of the purchase price. The purchaser's right to terminate the contract with consequent refund of the price paid remains unaffected. Amevista shall be liable for defects of conformity if they occur within two years from the date of delivery of the goods. The purchaser's obligation to report the lack of conformity must be fulfilled within two months of its discovery.
3.6 The warranty does not cover damage caused by misuse (misuse also being understood to include constant use in exceptional environmental conditions, such as saunas, steam baths, marine or high mountain environments), poor maintenance, accidents, or deterioration due to normal wear and tear of the product.
3.7 With reference to the activation and extension of the Legal Warranty:
- Each request will be evaluated individually, even if it refers to the same product that has already been replaced or repaired;
- The warranty period is not renewed or extended in case of repair: the expiration date remains that of the original purchase; if a defect reoccurs, a new warranty claim can be made, provided it is within the validity period;
- The warranty period is renewed if the defective product is replaced in full;
- In case of misuse of the warranty procedure (e.g., repeated claims for non-covered damage), Amevista reserves the right to reject the claim.
3.8 Warranty covers:
- Missing components;
- Delamination of sunglass lens coating;
- Bubbles or imperfections in the lens coating;
- Flaking or deterioration of the frame;
- Welding defects.
3.9 Warranty does not cover:
- Misalignment of the rods;
- Scratches or lines due to normal wear and tear;
- Damage caused by accident, negligence, shock, misuse, or improper storage/maintenance;
- Damage caused by contact with chemicals;
- Unauthorized modifications or repairs;
- The non-conformity of products only because they are customized or altered from their original state according to the buyer's specifications.
3.10 In case of conformity defect and subsequent replacement of the product following the activation of the warranty:
- We recommend using traceable shipping and keeping proof of shipment.
- Shipping costs for returning the product are the responsibility of the customer.
- Amevista assumes no responsibility for any damage, loss or delay due to transportation.
3.11 Upon receipt of the product, Amevista will check whether the defect falls within the conditions of application of the Legal Warranty. If not, if the product must be returned to the customer, a 5 EUR shipping cost will be charged, payable via a link sent via e-mail. Shipping will be done only after receipt of payment.
3.12 To be accepted for activation of the Legal Warranty, the product must be returned:
- With the original lenses.
- With all original accessories: case, piece, certificate and lenses.
- Clean and in proper hygienic condition.
Otherwise, Amevista reserves the right to reject the warranty claim.
3.13 For more information on the rules of exercise and operation of the Legal Warranty, our "Support" service can be contacted through the appropriate function.
3.14 To the extent permitted by law, Amevista disclaims any liability in the event that the delivered product does not comply with the legislation of the country of delivery other than Italy.
3.15 Amevista shall not be liable in case of delay in delivery of the purchased goods due to insufficient stock at the supplier and in case of insubstantial differences between the purchased goods and their illustrative pictures and text descriptions published on our website.
3.16 Except in the case of willful misconduct or gross negligence, Amevista shall only be liable for any direct and reasonably foreseeable damage at the time of the conclusion of the sales contract. Therefore, it shall not be liable for any direct or indirect damages to persons or property resulting from the malfunctioning of the products, for any losses incurred, lost revenue or profit, or any other damage that is not an immediate and direct consequence of the non-performance or that was not foreseeable at the time of the conclusion of the sales contract. Amevista is not in any way responsible for the performance of obligations against third parties that may offer warranties of any kind in connection with the products for sale on the Site or that are legally chargeable to such third parties.
3.17 In the event of Buyer's breach of these General Terms and Conditions, Amevista's failure to exercise its right of action does not constitute acquiescence and waiver of action for Buyer's breach of its commitments.
4. EYEGLASSES
4.1 With respect to any order that includes sales of products pursuant to a prescription from a medical specialist or optometrist ("Order with Prescription"), Customer warrants, covenants, and represents:
(a) who is at least 18 years of age and possesses the legal right, capacity to act and power to obligate himself or herself to the following terms;
(b) to provide any details reasonably requested by Amevista to confirm that it is eligible to purchase the products;
(c) that he or she is acting in his or her capacity as an individual consumer and that the products or any part of the products will not be used for resale or for any other purpose other than his or her personal use, except as set forth in Section 4.2 below;
(d) who is the authorized holder of any credit/debit card he or she may use on the site;
(e) that your order submission and use of the products comply or will comply with all applicable laws;
(f) that with regard to any order, for glasses with "progressive" lenses, he is ordering such glasses for his own use and not on behalf of another person.
4.2 Except as set forth in (f) above, a parent and/or legal guardian may place an Order for their minor child (a "Minor"). In connection with such Order;
(i) "You" (and its derivations) shall be deemed to include the Minor for the purposes of the Terms and Conditions;
(ii) it is the obligation of the parent and/or legal guardian to ensure that the Minor complies with these Terms and Conditions and complies with all laws applicable to the Minor's use of the Products.
5 DELIVERY AND SHIPPING
5.1 Amevista entrusts its shipments to DHL Couriers, Bartolini, Dpd, Chronopost, Seur.
5.2 Products are normally ready for shipment within the day following the customer's order, except for products not in stock. Unless otherwise specified, delivery will be made within 1 to 6 business days to the address indicated at the time of the order, depending on the shipping method selected and the country of destination, unless delays in customs clearance practices not attributable to Amevista.
5.3 The different shipping options available will be displayed at checkout.
5.4 Making graded, custom lenses or lenses with special treatments (e.g., blue light filter) takes up to 6 days, which is in addition to the shipping time mentioned in Section 5.2 above. If the customer chooses to send or upload the prescription to their Personal Area after the order is completed, a few additional days will be required.
5.5 When the products are ready and will be shipped, the customer will receive an order confirmation e-mail within which they will find the link to view the shipment details.
5.6 Amevista strongly discourages the use of the endorsement against the courier upon receipt of the package. If the customer authorizes the courier to leave the package without signature, Amevista will not be able to accept claims or requests for reimbursement in the event of loss, theft or damage. Responsibility in these cases is entirely the responsibility of the customer.
5.7 In the event that the contracted courier fails to complete delivery of an order due to unforeseen circumstances or lack of response from the recipient and informs Amevista that, without receiving instructions from the recipient or from Amevista within the next day, the package will be returned to Amevista's warehouse, the customer will be responsible for the costs of a new shipment. Costs that include any storage charges and customs fees that Amevista may have incurred. Therefore, it is essential that the customer provide a correct delivery address and be contactable to receive the package as communicated by the carrier.
5.8 At the time of the original shipment, Amevista has already borne all import costs in the buyer's country, including VAT, duties and customs clearance charges. To avoid additional customs charges when returning from countries outside the EU, it is recommended that you follow the return instructions carefully and use only the documents provided by Amevista. Failure to do so may result in additional charges from customs, which are also the responsibility of the customer.
5.9 Import duties are not applicable if the order comes from an EU country.
5.10 Amevista cannot take responsibility for delays in customs clearance or failed payments, although we will try to minimize any delays.
5.11 When placing orders on the Site, of goods delivered outside the European Union, the buyer is considered to be an importer and must comply with all legislation and regulations of the country in which he receives the goods. Deliveries across borders are subject to opening and inspection of the goods by customs authorities.

6.2 PSD2 is a European regulation that makes online payments more secure. When you place an order online using a payment card, the bank may ask you to confirm your identity through 3D Secure authentication. There are several ways to authenticate online payments, and you may be asked to confirm your identity via SMS, e-mail, or TouchID. Once the payment has been authenticated, the order will be placed and you will return to the order confirmation page. As soon as the order is confirmed, the customer will receive an order confirmation e-mail.
Gift Card Payment
6.3 To pay by Gift Card you must enter the Gift Card code in the field related to it by then clicking on the "use code" option (order step, "go to cart"). If the value of the order is greater than the value of the Gift Card you must choose one of the other payment methods to pay the remaining amount. Conversion of the Gift Card value into cash is excluded.
6.4 To pay by promotional code you have to enter it in the field related to it by clicking then on the option "use code" (ordering phase, "go to cart"). If the value of the order is greater than the value of the promotional code you must choose one of the other payment methods to pay the remaining amount.
7. MODALITIES OF THE RIGHT OF WITHDRAWAL, INDIVIDUAL EXCEPTIONS, SHIPPING AND RETURN COSTS
RIGHT OF WITHDRAWAL, RETURN FEES AND REFUNDS
7.1 Subject to the exceptions referred to in paragraph 7.10, the buyer has the right to withdraw from the concluded contract, without having to give any reason, within 30 days from the day on which he received the ordered product (or the last product, lot or piece in the case of multiple goods, lots or pieces delivered separately). If the purchaser has appointed a person he or she trusts to pick up the product, the right of withdrawal begins on the day the product is delivered to the designated person, other than the courier.
7.2 The exercise of the right of withdrawal must be communicated to Amevista Srl, by starting the return procedure present in the Personal Area, "Orders" section, following the instructions available within the page. Those who have made the purchase in "guest" mode, must first register on the Amevista website with the e-mail address used at the conclusion of the contract and carry out the order reconciliation procedure.
7.3 It is mandatory to accompany the package containing the return with the forms available to the customer at the end of the procedure, found in the Personal Area, "Returns" section; each form should be printed, inserted inside the box and attached outside the box, according to the instructions on the sheets. The return label will serve only to identify the package within the Amevista warehouse. The customer must make their own arrangements for the return shipment using a courier of their choice.
7.4 The integrity of the returned unused products, with their original labels and in their original boxes with the order reference number inside, is an essential and necessary condition to be able to exercise the right of withdrawal.
7.5 Goods must be returned to Amevista immediately and in any event no later than 30 days after the date of the notice referred to in paragraph 7.2.
7.6 Following lawful withdrawal, Amevista will refund all payments received in connection with the product for which the right of withdrawal has been exercised, within 14 days from the day it received the product at its warehouse.
7.7 Refund of the amount will be made by crediting the same channel that the customer has chosen for payment, unless otherwise agreed. Credit to the cards will be visible within 10 business days, depending on the repayment timeframe provided by the card issuing institution. Any losses due to exchange rate fluctuations will not be refunded.
Amevista may withhold the refund until it has received the product or until proof is provided that it has been returned to Amevista. Direct costs for returning products are the responsibility of the buyer who has communicated withdrawal. The buyer who has communicated the withdrawal is responsible for the decrease in the value of the goods resulting from handling of the goods (other than that necessary to establish the nature, characteristics and functioning of the goods) and damage to the goods. Returns are accepted only if they come from the same country where delivery was made. For example, if the delivery was made in Germany the return must also come from Germany.
7.8 If the customer has paid for the entire order using a Gift Card the amount will be refunded with another Gift Card to be used for his next orders in accordance with paragraph 2.4 above.
7.9 If the customer paid for his order by combining a Gift Card with a different payment method, in the event of a return, the refund will be made to the other payment method selected when the order was paid for. For example, if the customer used a credit card and a Gift Card, the refund will be made to their credit card and the Gift Card will be used by charging it against the items they kept. If the amount of the Gift Card is greater than the amount used with the other payment method, the refund will be made to the Gift Card.
EXCLUSIONS OF THE RIGHT OF WITHDRAWAL
7.10 The right of withdrawal does not apply in case of:
(a) damaged products or deprived of the quality seal applied on the glasses. Amevista uses a special transparent tamper-proof envelope for shipments that shows clear signs of tampering in case of theft or attempted theft. Therefore, if the shipping envelope appears damaged or tampered with, the customer must refuse the delivery. Should the tamper-proof envelope appear to be intact, the customer will still have 8 days from the delivery date resulting on the courier's website to notify Amevista of any damage; otherwise, the report cannot be accepted.
(b) purchases of sealed goods that are not suitable for return for hygienic or health protection-related reasons and that have been opened by the purchaser after delivery, such as contact lenses;
(c) supply of goods prepared to measure outside the sizes normally sold or customized by us following the instructions given when placing the order, such as frames with graduated and/or colored lenses or goods otherwise altered from their original state.
7.11 In cases where the return is assessed by Amevista as excluded from the right of withdrawal, the customer must arrange at his or her own expense to collect the goods from Amevista's warehouse.
DEFECTIVE PRODUCTS, RETURN CHARGES IN THE CASE OF REPLACEMENT OR WAIVER OF PURCHASE
7.12 Amevista performs product quality control before shipping the eyeglasses. Custom lenses applied at the buyer's request are of Italian production, of the highest quality, technologically advanced, but do not bear the logo or trademark of the eyeglass manufacturer. Together with the customized product, Amevista also provides the original lenses if the product purchased and whose customization was requested is equipped with them. In case of a damaged or defective product, the customer must notify Customer Service within 8 calendar days of receiving the product, providing all the requested information. After careful verification and possible subsequent confirmation by Amevista, we will proceed to withdraw the products and send replacement goods. In this case, the cost and reservation of the recall, as well as the cost of resending the replacement product, will be borne by Amevista. Conversely, if the product is damaged or defective and is only returned, the cost will be borne by the customer. In case of collection of the goods, the customer cannot deposit them at a fermopoint. To ensure compliance with customs regulations and facilitate the return process, Amevista requires that all graded lenses be removed from the frames prior to return and not included in the return package. Failure to comply with this condition may result in the return being blocked by customs authorities, thus preventing Amevista from proceeding with the case resolution.
7.13 Any freight charges paid by the purchaser for the return will not be refunded in the event of a reasoned rejection of the goods by Amevista.
7.14 Returns are accepted only if they come from the same country where the delivery was made. For example, if the delivery was made in Germany the return must also come from Germany.
7.15 In case of return without replacement, the refund amount will be credited to the payment method used at the time of purchase; any loss due to fluctuation of exchange rates will not be refunded.
7.16 Orders for customized products as stated in paragraph 7.10.c). above cannot be cancelled and therefore cannot be returned or refunded.
GENERAL FORECASTS
7.17 Goods to be returned must be sent to the following address: Amevista Srl - Via Flaminia, 844 - 00191 Rome, Italy. Returns sent to different addresses and not received at Amevista's warehouse will not be considered.
7.18 Amevista does not accept returns made with shipments via EVRI-HERMES courier due to recurring issues in the handling of related shipments.
7.19 Amevista recommends using an insured shipment. In case of loss or damage in transit, only an insured shipment allows you to request a refund from the carrier. Otherwise, the cost of the product remains the responsibility of the sender. It is also recommended to keep the proof of shipment.
7.20 Even in the case of multiple orders (an order with at least two glasses), each individual item returned to Amevista must be shipped at the customer's expense, separately from the others, each with its own shipping tracking. If the products will be returned in a single box or in different boxes but with a single shipment (multicollar), EUR 10 will be withheld for each individual item returned, directly from the payment method used during purchase.

8. CHANGES TO THE GENERAL CONDITIONS OF SALE
8.1 Buyer is subject to the terms of the Terms and Conditions of Sale in effect from time to time at the time it places its order on the Site.
8.2 Should any provision of these Terms and Conditions be held invalid, void, or for any reason ineffective, this shall not, however, affect the validity and application of the other provisions.
8.3 Amevista reserves the right to make changes to these Terms and Conditions at any time by posting the updated version on the Site.
9. APPLICABLE LAW AND COMPETENT COURT
9.1 These General Terms and Conditions of Sale are governed by and shall be enforced in accordance with the laws of Italy and the UN Convention on Contracts for International Sale and Purchase shall not apply.
9.2 Unless otherwise desired by the consumer customer who may decide to avail himself of paragraph 9.1 above:
(a) if the consumer customer is a resident of the EU, the applicable law is that of his or her country of residence and, therefore, the rules of the General Terms and Conditions of Sale, which are inconsistent with the applicable law in the customer's country of residence, shall be deemed to be supplemented or superseded by the mandatory and non-derogable rules in force in the customer's country of residence.
(b) if the consumer customer is resident outside the EU, and there are no international treaties, conventions or agreements that, for the purposes of the consumer's online purchases, assimilate his or her Sate of residence to an EU country, the applicable law is as set forth in paragraph 8.1 above.
9.3 In the event of a dispute between Amevista and the purchasing customers, the jurisdiction of the Italian Courts and Tribunals shall apply, unless a mandatory and non-derogable rule, applicable to the sale of Amevista made to the consumer customer, provides for the latter the possibility to act before Courts and Tribunals other than the Italian Courts and Tribunals to enforce its rights.
