GENERAL TERMS OF USE AND SALE

The general terms of use and sale apply to all orders placed from the date of the last update indicated above. For orders placed before that date, please refer to the previous versions and consider the version in force at the time of the order.
Amevista Srl (“Amevista”) and/or its possible foreign branches provide you with the Website features and other products and services when you visit or make purchases on Amevista.it (the “Website”), use Amevista devices, products or services, Amevista applications for mobile devices or software provided by Amevista in relation to any of the above activities (collectively, the “Amevista Services”). Please read our Privacy Policy and our Cookie Policy to understand how we collect and process your personal data through the Amevista Services. Amevista provides the Amevista Services under the following terms and conditions (“General Terms of Use and Sale”).

I) GENERAL TERMS OF USE
Please read carefully these general terms of use (“General Terms of Use”) before using the Amevista Services. By using the Amevista Services, you fully accept these General Terms of Use. Since various Amevista Services are available, you may sometimes be subject to different and/or additional terms and conditions. When you use an Amevista Service (for example: the Personal Area, Gift Cards or Amevista applications for mobile devices), you will also be subject to the terms, guidelines and general conditions applicable to that specific Amevista Service (“Service Terms”). In case of conflict between these General Terms of Use and the Service Terms, the Service Terms will prevail.
1. COMMUNICATION METHODS
1.1 When you use the Amevista Services, receive or send e-mails, text messages (SMS) and other communications from your computer or mobile device, you are communicating with us electronically.
1.2 Amevista may communicate with you in various ways, for example via e-mail, text messages (SMS), in-app notifications, or by posting messages and communications on the Website or through other Amevista Services.
1.3 Without prejudice to mandatory legal provisions, for the purposes of this agreement you accept that all contracts, notices, disclosures and other communications that we provide you electronically satisfy the requirement of written form and may be printed on paper, where required by law.
2. PERSONAL AREA
2.1 You may need your Amevista account (“Personal Area”) to use certain Amevista Services and may be required to access your Personal Area as well as to have a valid payment method associated with it.
2.2 If there is a problem charging your selected payment method, we may charge any other valid payment method you have associated with your Personal Area. Access the relevant page to manage your payment options.
2.3 If you use the Amevista Services, you must keep your Personal Area and password confidential and control access to your computer and devices, as you are responsible for all activities carried out through your Personal Area and password. You therefore undertake to take all precautions necessary to ensure that your password remains secure and confidential and to inform us immediately if you have reason to believe that any third party is aware of your password, or if your password is, or is likely to be, used without authorization. You may access your information in the “My Personal Area” section of the application also to modify the information previously provided. Please refer to our dedicated pages on how to protect your privacy to access your personal data.
2.4 It is forbidden to use the Amevista Services for fraudulent purposes, or in any case to carry out unlawful activities, or to cause malfunctions of the Website and/or issues and damages to Amevista’s business.
2.5 We reserve the right to close your Amevista Personal Area and/or to limit access to and use of the Amevista Services in the event of a breach of applicable law, these General Terms of Use and Sale, the Service Terms, our guidelines or our policies, all of which are available on our Website.
2.6 We will inform you in writing by e-mail of the closure of your Amevista Personal Area or of the limitation of access to and use of the Amevista Services.
2.7 You may close your Amevista accounts at any time by accessing the “My Personal Area” page.
3. OWNERSHIP AND USE OF INTANGIBLE RIGHTS
3.1 All content present or made available through the Amevista Services in the form of texts, graphics, logos, button icons, images, audio files, digital downloads, data collections and software is the property of Amevista or its product and content suppliers and is protected by laws on copyright and database rights.
3.2 It is not permitted to extract, download and/or use for purposes other than those proper to the Website any parts of the Amevista Services without the express written consent of Amevista, nor to create and/or publish your own database that reproduces substantial parts (e.g. prices and product lists) of the Amevista Services without the express written consent of Amevista.
3.3 The trademarks appearing on any of the Amevista Services or on products sold by Amevista are the property of their respective owners, who may or may not be linked or connected to Amevista, sponsors of or sponsored by Amevista.
3.4 Provided that you comply with these General Terms of Use, the Service Terms and you pay any applicable fees, Amevista or its content supplier grants you a limited, temporary, non-exclusive and non-transferable licence to access the Amevista Services and make personal and non-commercial use of them. This licence does not include any right of resale or commercial use of any Amevista Service or its contents, nor the right to collect and use product lists, descriptions, product sheets, lists or product prices, to make any derivative use of the Amevista Services or their contents, to download or copy any information or content of the Website for the benefit of another retailer or to use data mining, robots or similar data gathering and extraction tools. All rights not expressly granted by these General Terms of Use or by the Service Terms remain with Amevista or its licensors and suppliers of goods and services.
3.5 It is forbidden to reproduce, copy, sell or use for any commercial purpose the Amevista Services, in whole or in part, without Amevista’s written consent. It is forbidden to appropriate by any means any trademark, logo or other proprietary information (including images, text, page layout or format) of Amevista without express written consent.
3.6 Breach of these General Terms of Use or of the Service Terms will entail compensation for both material and non-material damages in favour of Amevista.
4. REVIEWS
4.1 Amevista customers are allowed to post reviews and other content, send communications and submit suggestions, ideas, comments, questions or other information, provided that the content is not unlawful. By way of example, unlawful content includes anything intimidating, defamatory, in breach of privacy, in violation of Amevista’s or third-party intellectual property rights or otherwise offensive to Amevista and/or third parties, or objectionable, or containing viruses, political propaganda, commercial solicitations, chain letters, mass e-mails or any other form of spamming. Amevista uses a commercial and financial data control system capable of verifying that reviews originate from its customers.
4.2 It is forbidden to use a false e-mail address, impersonate any person or entity or otherwise mislead as to the origin of any content.
4.3 We reserve the right to remove or modify unlawful or prohibited content, without prejudice to Amevista’s right to compensation as set out in paragraph 3.6 above.
4.4 If you believe that any content or sales listing published on the Website or used in the Amevista Services contains a defamatory statement, or that your intellectual property right has been infringed by an item or information present on the Website or used in the Amevista Services, please send us an appropriate notice through the Customer Service function and we will promptly take the appropriate actions.
4.5 If you decide to publish customer reviews, comments, questions or customer answers, or to submit other video or audio content created by you for display on the Website, you grant Amevista a free-of-charge licence to use, reproduce, publish, make available, translate and modify such content worldwide (including the right to sub-licence to third parties) and the right to use the name you submit in connection with such content.
4.6 You may delete your content from displaying on our Website at any time.
4.7 You represent and warrant that you own and/or otherwise control all of the rights to the content you post; that, as of the date the content or material is submitted, the content is accurate and relevant and that such use does not cause harm or prejudice to Amevista or any third party. You therefore undertake to hold Amevista harmless from all legal actions brought by third parties against Amevista arising from or otherwise related to the content you have posted.
5. RESTRICTIONS ON THE EXPORT OF PURCHASED PRODUCTS
5.1 It is forbidden to export, re-export or transfer any product you have purchased on the Website to any State, individual, company, organisation or entity where such export is restricted or prohibited by law. You therefore accept, for example, that economic sanctions and embargoes imposed by the European Union, the United Nations and other governmental authorities (such as embargoes on specific countries or economic sanctions imposed on individuals or companies for terrorism or money laundering offences) may prohibit you from carrying or sending products, even for personal use, to other countries and/or from sending or carrying products to certain individuals, companies, organisations or entities. Furthermore, you agree not to purchase any product or service from the Website if you are yourself subject to restrictive measures (sanctions).
6. MINORS UNDER 18 YEARS OF AGE
6.1 We do not sell products to persons under 18 years of age. We sell products for children which can only be purchased by adults. If you are under 18, you may use the Amevista Services only through a parent or guardian.
7. NOTICE AND PROCEDURE FOR REPORTING ILLEGAL CONTENT
7.1 If you believe that your intellectual property rights have been infringed, please send a report to Customer Service. You may report alleged infringements of all intellectual property rights, including, by way of example, reports concerning trademarks, designs and patents.
7.2 Once a report has been received, we may take various actions. For example, we may remove the information relating to an item or remove an item. Our actions are taken without this implying any admission of liability and without prejudice to any of our rights, remedies or defences, which we expressly reserve the right to exercise. This includes forwarding the report to the parties involved in the creation of the content considered unlawful. You undertake to hold Amevista harmless from all third-party actions against Amevista arising from or connected with the sending of a report.
7.3 If you wish to report any other issues concerning products, content or a product page, for example because you believe that the product or content is unlawful, you may send a report through Customer Service. Providing false, misleading or inaccurate information in the report may give rise to civil and/or criminal liability. For any questions, please consult a lawyer.
7.4 Product sheets from our suppliers are merely stored on the Website and are published solely in accordance with the instructions of our suppliers.
8. OUR DUTIES
8.1 As part of the Amevista Services, where authorised, we will recommend features, products and services, including third-party advertisements that may be of interest to you and, in addition, we will identify your preferences and customise your experience.
8.2 It is our duty to ensure that access to the Amevista Services is provided without interruption and that transmissions are error-free. However, due to the nature of the Internet, uninterrupted access and error-free transmission cannot be guaranteed. In addition, your access to the Amevista Services may occasionally be suspended or limited to allow for repairs, maintenance or the introduction of new activities or services.
9. LIMITATIONS OF LIABILITY
9.1 In the event of your breach of the General Terms of Use and Sale, our failure to exercise the right to act against you does not constitute a waiver of our right to act for the breach of the obligations you have undertaken.
9.2 Amevista shall not be liable for any loss or damage that is not a direct consequence of the breach of these general conditions, nor for any loss of business opportunities (including, by way of example, lost revenue, contracts, anticipated savings, goodwill or wasted expenditure) or for any other indirect or consequential loss that is not reasonably foreseeable.
9.3 Amevista shall also never be liable for any delay or failure in performing its obligations under the General Terms of Use and Sale where such delay or failure results from unforeseeable circumstances or force majeure. This provision shall not affect your rights under the law and in particular your right to receive the goods purchased within a reasonable time or to be refunded in case of non-delivery due to unforeseeable circumstances or force majeure.
9.4 Please note that the applicable laws in some States may limit and/or prohibit the liability limitations indicated above. In the event that such laws apply, the above liability limitations and/or exclusions will not be effective and you may be entitled to the rights provided by such laws.
10. AMENDMENTS TO THE GENERAL TERMS OF USE
10.1 We reserve the right to amend these General Terms of Use, our guidelines and our policies at any time, in order to comply with legal and regulatory provisions, to make them clearer or easier to understand, to reflect any changes to the Amevista Services, or for any other reason, by publishing the updated version on Amevista.it or on any other website or application used to provide the Amevista Services. If a material change is made to these General Terms of Use, you will be informed of it before using the Amevista Services.
10.2 The General Terms of Use, guidelines and our policies in force are those applicable at the time you use the Amevista Services. You may stop using any Amevista Service, close your Amevista Personal Area or cancel the related Amevista Services at any time and for any reason, including in the event of changes.
10.3 Should any provision of these terms be deemed invalid, void or for any reason unenforceable, this shall in any case not affect the validity and effectiveness of the remaining provisions.

12. APPLICABLE LAW AND JURISDICTION
12.1 These General Terms of Use are governed by and must be interpreted in accordance with Italian law.
12.2 Without prejudice to the different will of the user of the Amevista services who may decide to avail himself of paragraph 12.1 above:
a) if the user is a consumer resident in the EU, the applicable law is that of the country of his or her residence and, therefore, the rules of the General Terms of Use that are not in line with the applicable law in the user’s country of residence shall be deemed supplemented and/or replaced by the mandatory and non-derogable rules in force in the user’s country of residence.
b) if the user is resident outside the EU and there are no treaties, conventions or international agreements which, for the use of the Amevista services, assimilate his or her State of residence to an EU country, the applicable law is that referred to in paragraph 12.1 above.
12.3 In case of a dispute between Amevista and users of the Amevista services, the jurisdiction of the Italian Courts and Tribunals shall apply, unless a mandatory and non-derogable rule applicable to the user of the Amevista services grants the latter the possibility to bring proceedings before courts and tribunals other than the Italian ones in order to assert his or her rights.
II) GENERAL TERMS OF SALE
Preamble
The company Amevista Srl, Via Flaminia 968, 00189 Rome – VAT no. 14956881008 (hereinafter referred to as “Amevista” or “Amevista.com”), operates an online shop through the website www.amevista.com (hereinafter referred to as the “Website”).
For all orders placed through the Website (and language subdomains) as well as for all sales and ancillary services to sales, only and exclusively the general conditions set out below shall apply.
By submitting the order, the customer agrees not to use the ophthalmic lenses and/or contact lenses and/or glasses for hearing assistance (NUANCE) and/or glasses with camera and AI technology (META) before having read and fully understood the instructions for their proper use, as well as the warnings, precautions and risks associated with their use as described in the purchased packaging. For any doubt, advice and, where necessary, examination of the ophthalmic or contact lenses, the customer may contact one of our specialists in the “Support” section.
By submitting the order, the customer:
- declares that he/she is over 18 years of age;
- declares that he/she has undergone the periodic check-ups required by his/her ophthalmologist and optometrist, each for their respective fields and competences;
- declares that he/she has previously consulted an ophthalmologist regarding the suitability and compatibility of the product ordered;
- declares that the product ordered corresponds to his/her ophthalmologist’s prescription;
- releases Amevista from any liability related to the purchase of an unsuitable product;
1. SUBJECT MATTER AND CONCLUSION OF THE CONTRACT

1.2 The contract concerns the sale of products whose description and price are indicated on the Website. In the case of discount offers, outside Black Friday sales or specific personal events (birthdays, etc.), the lowest price applied to all customers in the last 30 days will be indicated together with the price shown on the Website.
1.3 All orders placed on the Website must correspond to normal consumer needs. This requirement applies both to the number of products purchased with a single order and in the case of multiple orders for the same product.
1.4 A user who wishes to purchase one or more products may select them one at a time, adding them to his or her cart. Once all the items he or she intends to purchase have been selected, the user may close the cart and submit the order. At this point, a summary page will appear showing the selected products, their price and the delivery options (with the related costs). The user will then be asked to choose the preferred delivery, shipping and payment method. Before submitting the order, the customer will see a summary containing all the data entered and the option to correct any errors.
1.5 On the same page, a specific “Proceed to order” button will be highlighted, which must be clicked to place the order. The order may also be placed using “Express checkout” as the payment method.
The order is considered a concrete and binding contractual offer addressed to Amevista for the purchase of the products listed at the indicated price, each product being considered individually. Upon receipt of the order, we will automatically send an e-mail informing you that we have received the order (“Order Confirmation”) and summarising the order details.
1.6 The Order Confirmation does not constitute acceptance of the purchase offer, but simply confirms that we have received the order and submitted it to our verification process. The sales contract with Amevista will be concluded only when we ship the products, such shipment constituting tacit acceptance of the customer’s purchase offer. Should such shipment not take place because Amevista has not accepted the order, the advance payment will be refunded to the customer. You may cancel your order before receiving the Order Confirmation, provided that it does not concern the purchase of customised products and that the order has not been prepared for shipment. In this case, no costs will be charged to you. In any event, the right of withdrawal under the terms and conditions of this contract remains unaffected.
1.7 The order data are stored. If the customer requests a copy of the order, he or she may print the “Order receipt confirmation” which appears on the screen after sending us the order by clicking the “Confirm order” button and after successful payment verification.
1.8 For each contract concluded, an invoice will be issued which the customer agrees to receive in electronic format. The invoice is also available in PDF format in the “Personal Area” section of the application. The issuance of the electronic invoice relating to an order will be communicated in the Order Confirmation.
2. PRICES, PRODUCTS, AVAILABILITY AND PROMOTIONAL CODES
2.1 All prices include VAT, fees and duties where applicable, according to the rates provided by law, as well as any fees for handling customs formalities as indicated at the time of the order on our Website. Any shipping costs are indicated in the cart in the specific section.
2.2 The products offered on the Website comply with EU regulations; contact lenses comply with the provisions and essential safety requirements imposed on the manufacturer by Directives 93/42/EEC, 90/385/EEC and 98/79/EC on medical devices, thereby guaranteeing the originality of the original products. All products are presented using digital photographs of actual existing products (minor variations between these photographs and reality do not constitute defects of conformity). The products are in no way manipulated by Amevista and are shipped with their original labels and packaging (where available, certificates of authenticity are also provided). The products can be customised in accordance with the purchaser’s instructions. The customised lenses fitted are manufactured in Italy, of very high quality and technologically advanced, but do not bear the logo or trademark of the eyewear manufacturer. Together with the customised product, Amevista also supplies the original lenses if the purchased product for which customisation has been requested is provided with them.
2.3 Information on the availability of the products we sell is provided on the Website and on the product detail page for each item. In addition to the information provided on that page or elsewhere on the Website, we are unable to provide more precise indications regarding product availability.
3. WARRANTIES, LIABILITY AND WAIVER OF CLAIMS
3.1 Amevista guarantees full traceability of the purchase of all products it sells and certifies their exclusive provenance directly from manufacturers and official suppliers.
3.2 If you purchase as a “consumer”, you benefit from the statutory conformity guarantee to which Amevista, as seller, is legally bound for each good sold (“Statutory Guarantee”).
3.3 The Statutory Guarantee protects the good against any lack of conformity with the sales contract.
3.4 If you find a lack of conformity in goods purchased from Amevista during the validity period of the Statutory Guarantee, please contact the “Support” service through the relevant function.
3.5 In the event of defects and consequent applicability of the Statutory Guarantee, Amevista is obliged to repair or replace the product, or, if this is not possible, to reduce the purchase price. The purchaser’s right to terminate the contract, with the consequent refund of the price paid, remains unaffected. Amevista is liable for any lack of conformity that becomes apparent within two years from the date of delivery of the goods. The purchaser’s obligation to report the lack of conformity must be fulfilled within two months from its discovery.
3.6 The guarantee does not cover damage caused by improper use (improper use also meaning constant use in exceptional environmental conditions, such as saunas, steam baths, marine environments or high mountain environments), poor maintenance, accidents or deterioration due to normal wear and tear of the product.
3.7 With regard to the activation and extension of the Statutory Guarantee:
- Each request will be assessed individually, even if relating to the same product already replaced or repaired;
- The guarantee period is neither renewed nor extended in the event of repair: the expiry date remains that of the original purchase; if a defect reoccurs, a new guarantee request may be submitted, provided it is within the validity period;
- The guarantee period is renewed in the event of a full replacement of the defective product;
- In the event of improper use of the guarantee procedure (e.g. repeated requests for damage not covered), Amevista reserves the right to reject the request.
3.8 The guarantee covers:
- Missing components;
- Delamination of the coating of sunglass lenses;
- Bubbles or imperfections in the lens coating;
- Peeling or deterioration of the frame;
- Welding defects.
3.9 The guarantee does not cover:
- Misalignment of the temples;
- Scratches or marks due to normal wear and tear;
- Damage caused by accident, negligence, impact, improper use or incorrect storage/maintenance;
- Damage caused by contact with chemical products;
- Unauthorised modifications or repairs;
- Non-conformity of products solely because they have been customised or altered from their original condition in accordance with the purchaser’s instructions.
3.10 In the event of a lack of conformity and consequent replacement of the product following activation of the guarantee:
- It is recommended to use a trackable shipment and to keep proof of dispatch.
- The shipping costs for returning the product are borne by the customer.
- Amevista accepts no liability for any damage, loss or delay caused during transport.
3.11 Once the product has been received, Amevista will verify whether the defect falls within the conditions for application of the Statutory Guarantee. If not, and if the product is to be returned to the customer, a shipping fee of EUR 5 will be charged, payable via a link sent by e-mail. Shipment will take place only after receipt of payment.
3.12 In order for activation of the Statutory Guarantee to be accepted, the product must be returned:
- With the original lenses.
- With all original accessories: case, cloth, certificate and lenses.
- Clean and in adequate hygienic conditions.
Otherwise, and within the limits provided by law, Amevista reserves the right to reject the guarantee request.
3.13 For more information on the rules governing the exercise and operation of the Statutory Guarantee, our “Support” service may be contacted through the dedicated function.
3.14 Within the limits permitted by law, Amevista declines all liability in the event that the product delivered does not comply with the legislation of the country of delivery other than Italy.
3.15 Amevista shall not be liable in the event of delayed delivery of goods purchased due to lack of stock at the supplier and in the event of non-substantial differences between the goods purchased and their illustrative images and text descriptions published on our Website.
3.16 Except in cases of wilful misconduct or gross negligence, Amevista is only liable for any direct damage that is reasonably foreseeable at the time of conclusion of the sales contract. It is therefore not liable for direct or indirect damage to persons or property arising from malfunction of the products or failure to observe the prescribed precautions for use, nor for any losses suffered, loss of income or profit, or any other damage that is not an immediate and direct consequence of the breach or that was not foreseeable at the time of conclusion of the sales contract. Amevista is in no way liable for the fulfilment of obligations on the part of third parties who may offer any kind of guarantee in relation to the products for sale on the Website or which are legally borne by such third parties.
3.17 In the event of the purchaser’s failure to comply with these General Terms of Sale, Amevista’s failure to exercise its right to act does not constitute acquiescence or waiver to act for the breach of the commitments undertaken by the purchaser.
4. PRESCRIPTION GLASSES
4.1 With reference to any order that includes the sale of products in accordance with a prescription from a specialist doctor or optometrist (“Prescription Order”), the customer warrants, undertakes and declares:
a) that he/she is at least 18 years of age and has the legal right, capacity and authority to be bound by the following terms;
b) that he/she will provide any details reasonably requested by Amevista to confirm that he/she is eligible to purchase the products;
c) that he/she is acting as an individual consumer and that the products or part of the products will not be used for resale or for any other purpose than his/her personal use, except as provided in paragraph 4.2 below;
d) that he/she is the authorised holder of any credit/debit card that may be used on the Website;
e) that the submission of the order and the use of the products comply or will comply with all applicable laws;
f) that, with regard to any order for glasses with “progressive” lenses, he/she is ordering such glasses for his/her personal use and not on behalf of another person.
4.2 Except as provided in point f) above, a parent and/or legal guardian may place an order for his or her minor child (a “Minor”). In relation to such Order:
i) “You” (and its derivatives) shall be deemed to include the Minor for the purposes of the Terms and Conditions;
ii) it is the obligation of the parent and/or legal guardian to ensure that the Minor complies with these Terms and Conditions and with all applicable laws concerning the Minor’s use of the products.
5. DELIVERY AND SHIPPING
5.1 Amevista entrusts its shipments to the couriers DHL, Bartolini, Dpd, Chronopost, Seur.
5.2 Products are normally ready for shipment by the day after the customer’s order, with the exception of products not immediately available. Unless otherwise specified, delivery will be made within 1 to 6 working days to the address indicated at the time of the order, depending on the shipping method selected and the destination country, except for delays in customs clearance not attributable to Amevista.
5.3 The different shipping options available will be displayed at checkout.
5.4 The manufacture of prescription lenses, customised lenses or lenses with special treatments (for example blue-light filter) may take up to 6 days, which will be added to the shipping times referred to in paragraph 5.2 above. If the customer chooses to send or upload the prescription to his or her Personal Area after completing the order, a few additional days will be needed.
5.5 When the products are ready and will be shipped, the customer will receive an order confirmation e-mail containing the link to view the shipment details.
5.6 Amevista strongly advises against providing any waiver of liability to the courier at the time of delivery of the parcel. If the customer authorises the courier to leave the parcel without a signature, Amevista will not be able to accept claims or refund requests in case of loss, theft or damage. The responsibility in such cases lies entirely with the customer.
5.7 If the appointed courier is unable to complete the delivery of an order due to the recipient’s unavailability and informs Amevista that, unless it receives instructions from the recipient or from Amevista by the following day, the parcel will be returned to Amevista’s warehouse, the customer will be responsible for the costs of a new shipment. Such costs include any storage charges and customs expenses that Amevista may have incurred. It is therefore essential that the customer provides a correct delivery address and is available to receive the parcel according to the methods communicated by the courier.
5.8 At the time of the original shipment, Amevista has already borne all import costs into the purchaser’s country, including VAT, duties and customs clearance fees. To avoid additional customs charges in case of returns from countries outside the EU, it is recommended to follow the return instructions with the utmost care and to use exclusively the documents provided by Amevista. Failure to follow these instructions may result in additional costs charged by customs, which shall also be borne by the customer.
5.9 Import duties are not applicable if the order originates from an EU country.
5.10 Amevista cannot be held responsible for delays in customs clearance or unsuccessful payments, although we will endeavour to minimise any delays.
5.11 When placing orders on the Website for goods delivered outside the European Union, the purchaser is considered the importer and must comply with all legislation and regulations of the country in which the goods are received. Cross-border deliveries are subject to opening and inspection of the products by customs authorities.

6.2 PSD2 is a European regulation that makes online payments more secure. When placing an online order using a payment card, your bank may ask you to confirm your identity through 3D Secure authentication. There are several ways to authenticate online payments and you may be asked to confirm your identity via SMS, e-mail or TouchID. Once the payment has been authenticated, the order will be placed and you will be redirected to the order confirmation page. As soon as the order is confirmed, the customer will receive an order confirmation e-mail.
Payment by Gift Card
6.3 To pay by Gift Card, you must enter the Gift Card code in the relevant field and then click on the “use code” option (order phase, “go to cart”). If the order amount exceeds the Gift Card value, you must choose one of the other payment methods to pay the remaining amount. Conversion of the Gift Card value into cash is excluded.
6.4 To pay by promotional code, you must enter the code in the relevant field and then click on the “use code” option (order phase, “go to cart”). If the order amount exceeds the value of the promotional code, you must choose one of the other payment methods to pay the remaining amount.
7. RIGHT OF WITHDRAWAL PROCEDURE, SPECIFIC EXCEPTIONS, SHIPPING AND RETURN COSTS
RIGHT OF WITHDRAWAL, RETURN COSTS AND REFUNDS
7.1 Without prejudice to the exceptions referred to in paragraph 7.10, the purchaser has the right to withdraw from the concluded contract, without having to provide any reason, within 30 days from the day on which he/she received the ordered product (or the last product, batch or piece in the case of multiple goods, batches or pieces delivered separately). If the purchaser has entrusted the collection to a trusted person, the right of withdrawal starts from the day of delivery of the product to the designated person, other than the courier.
7.2 The exercise of the right of withdrawal must be communicated to Amevista Srl by starting the return procedure available in the Personal Area, “Orders” section, following the instructions available on the page. Those who have made the purchase as a “guest” must first register on the Amevista Website using the e-mail address entered when concluding the contract and carry out the order reconciliation procedure.
7.3 It is mandatory to enclose the parcel containing the return with the forms made available to the customer at the end of the procedure, available in the Personal Area, “Returns” section; each form must be printed, placed inside the box and attached to the outside of the box, according to the instructions on the sheets. The return label is used solely to identify the parcel within the Amevista warehouse. The customer must independently arrange return shipment using a courier of his or her choice, with the exception of the courier EVRI-HERMES. In the case of returns originating from non-EU countries, the return transit time may extend up to three months due to customs procedures, for reasons completely independent of Amevista and solely related to the customs flows and controls of the countries involved.
7.4 The returned product must be intact and free from signs of use. The product must be returned together with the original packaging, the original labels and with the order reference number inside.
7.5 The goods must be sent back to Amevista immediately and in any case no later than 30 days from the date of the communication referred to in paragraph 7.2.
7.6 Following lawful withdrawal, Amevista will refund all payments received in relation to the product for which the right of withdrawal has been exercised, within 14 days from the day it receives the product at its warehouse.
7.7 The refund of the amount will be made by crediting the same payment method chosen by the customer for the payment, unless otherwise agreed. The credit will be visible on the cards within 10 working days, depending on the refund times provided by the card issuer. Any losses due to exchange rate fluctuations will not be refunded.
Amevista may withhold the refund until it has received the product or until proof is provided that the product has been returned to Amevista. The direct costs for returning products are borne by the purchaser who has notified the withdrawal. The purchaser who has notified the withdrawal is responsible for any diminution in the value of the goods resulting from handling of the goods (other than that necessary to establish the nature, characteristics and functioning of the goods) and from damage to the goods. Returns are accepted only if shipped from the same country in which delivery was made. For example, if delivery was made in Germany, the return must also be shipped from Germany.
7.8 If the customer has paid the entire order using a Gift Card, the amount will be refunded with another Gift Card to be used for future orders, in accordance with paragraph 2.4 above.
7.9 If the customer has paid for the order by combining a Gift Card with another payment method, in the event of a return, the refund will be made to the other payment method selected at the time of payment of the order. For example, if the customer used a credit card and a Gift Card, the refund will be made to his or her credit card and the Gift Card will be used by allocating it to the items kept. If the value of the Gift Card is higher than the amount used with the other payment method, the refund will be made to the Gift Card.
EXCLUSIONS FROM THE RIGHT OF WITHDRAWAL
7.10 The right of withdrawal does not apply in the following cases:
a) products that are damaged or missing the quality seal applied to the glasses. For shipments, Amevista uses a special transparent tamper-evident bag which shows clear signs of tampering in case of theft or attempted theft. Therefore, if the shipping bag appears damaged or tampered with, the customer must refuse delivery. If the tamper-evident bag appears intact, the customer will still have 8 days from the delivery date shown on the courier’s Website to report any damage to Amevista; otherwise, the report cannot be accepted.
b) purchases of sealed goods which are not suitable for return for hygienic reasons or related to health protection and which have been opened by the purchaser after delivery, such as contact lenses;
c) supply of goods made to measure outside the sizes normally sold or customised by us according to the instructions provided at the time the order is placed, such as frames with prescription and/or coloured lenses or goods otherwise altered from their original condition.
d) damaged products for which the quality seal has not been removed, as in such cases the Statutory Guarantee referred to in article 3 applies.
7.11 In cases where the return is deemed by Amevista to fall outside the scope of the right of withdrawal, the customer must arrange collection of the goods from Amevista’s warehouse at his or her own expense.
DEFECTIVE PRODUCTS, RETURN COSTS IN CASE OF REPLACEMENT OR RENUNCIATION OF PURCHASE
7.12 Before shipping the glasses, Amevista carries out a quality control of the product. The customised lenses fitted at the purchaser’s request are manufactured in Italy, of very high quality and technologically advanced, but do not bear the logo or trademark of the eyewear manufacturer. Together with the customised product, Amevista also provides the original lenses if the purchased product for which customisation has been requested is supplied with them. In the event of a damaged or defective product, the customer must report it to Customer Service within 8 calendar days of receipt of the product, providing all the information requested. After a thorough check and any subsequent confirmation by Amevista, we will arrange collection of the products and shipment of replacement goods. In such case, the cost and booking of the collection, as well as the costs for sending the replacement product, will be borne by Amevista. Conversely, if the product is damaged or defective and is only returned, the costs will be borne by the customer. In the event of collection of the goods, the customer may not deposit the parcel at a pick-up point. To ensure compliance with customs regulations and facilitate the return process, Amevista requires that all prescription lenses be removed from the frames before returning the product and that such lenses are not included in the return parcel. Failure to comply with this condition may lead to the return being blocked by customs authorities, preventing Amevista from completing the case resolution.
7.13 Any transport costs paid by the purchaser for the return will not be refunded if the goods are legitimately refused by Amevista.
7.14 Returns are accepted only if shipped from the same country in which delivery was made. For example, if delivery was made in Germany, the return must also be shipped from Germany.
7.15 In the event of a return without replacement, the refund amount will be credited to the payment method used at the time of purchase; any losses due to exchange rate fluctuations will not be refunded.
7.16 Orders for customised products as indicated in paragraph 7.10.c) above cannot be cancelled and therefore cannot be returned or refunded.
GENERAL PROVISIONS
7.17 The goods to be returned must be shipped to the following address: Amevista Srl - Via Flaminia 968 - 00189 Rome, Italy. Returns sent to different addresses and not received at Amevista’s warehouse will not be taken into consideration.
7.18 Amevista does not accept returns shipped via the courier EVRI-HERMES, due to recurring issues in managing such shipments.
7.19 Amevista recommends using insured shipping. In the event of loss or damage during transport, only insured shipping allows the sender to claim a refund from the courier. Otherwise, the cost of the product will remain at the sender’s expense. It is also recommended to keep proof of dispatch.
7.20 Even in the case of multiple orders (an order with at least two pairs of glasses), each individual item returned to Amevista must be shipped at the customer’s expense, separately from the others, each with its own shipment tracking. If products are returned in a single box or in different boxes but with a single shipment (multi-parcel), EUR 10 will be retained for each item returned, directly from the payment method used at the time of purchase.

8. AMENDMENTS TO THE GENERAL TERMS OF SALE
8.1 The purchaser is subject to the General Terms of Sale in force from time to time at the time the order is placed on the Website.
8.2 Should any provision of these General Terms of Sale be deemed invalid, void or for any reason ineffective, this shall in any case not affect the validity and application of the remaining provisions.
8.3 Amevista reserves the right to make changes to these General Terms of Sale at any time by publishing the updated version on the Website.
9. APPLICABLE LAW AND COMPETENT COURT
9.1 These General Terms of Sale are governed by and must be interpreted in accordance with Italian law and the UN Convention on Contracts for the International Sale of Goods does not apply.
9.2 Without prejudice to the different will of the customer consumer who may decide to avail himself of paragraph 9.1 above:
a) if the customer consumer is resident in the EU, the applicable law is that of his or her country of residence and, therefore, the rules of the General Terms of Sale that are not in line with the applicable law in the customer’s country of residence must be deemed supplemented or replaced by the mandatory and non-derogable rules in force in the customer’s country of residence.
b) if the consumer customer resides outside the EU, and no treaties, conventions or international agreements apply that would treat the customer’s country of residence as an EU country for the purposes of online purchases, the applicable law is that referred to in paragraph 9.1 above.
9.3 In the event of a dispute between Amevista and purchasing customers, the jurisdiction of the Italian Courts and Tribunals shall apply, unless a mandatory and non-derogable rule, applicable to the sale made by Amevista to the customer consumer, grants the latter the possibility to bring proceedings before courts and tribunals other than the Italian ones in order to assert his or her rights.
