GENERAL CONTRACT CONDITIONS

§ 1 General provisions

Amevista Srl, Via Flaminia 844 – 00191 Rome - VAT number 14956881008 (hereinafter referred to as "Amevista" or "Amevista.com"), manages an online shop through the website www.amevista.com (hereinafter referred to as "site"). For all orders placed through this website (and language subdomains) as well as for all our supplies and services, only and exclusively the general conditions reported below apply in their version in force at the time of the order. Any conditions of the customer that differ from these are not valid, unless we have given our written consent.

The customer agrees not to use ophthalmic or contact lenses before having read and fully understood the Guide to the correct use of the same, as well as the warnings, precautions and risks associated with their use as described in the packages purchased. The customer for any doubts, consultations and, where necessary, examination of ophthalmic or contact lenses, can contact one of our specialists in the "Assistance" section.

By purchasing products on Amevista, you implicitly declare that:

  • you are over 18 years old;
  • the product ordered corresponds to the prescription of your ophthalmologist;
  • an ophthalmologist was consulted beforehand regarding the suitability and compatibility of the purchased product;
  • Amevista releases any liability related to the purchase of an unsuitable product;
  • you have undergone the periodic checks required by your ophthalmologist and optometrist, each for their respective fields and skills.

§ 2 Conclusion of the contract

2. The presentation of goods in the aforementioned online shop does not constitute a binding offer by Amevista for the conclusion of a sales contract.

3. The conclusion of the sales contract takes place by sending the appropriate order form, available on our website, with which the customer makes a binding offer by entering all the necessary data during the ordering process and finally sending this form by clicking on the "Proceed to order" button or by making the payment "Express checkout". Before sending the order, the customer sees a summary containing all the data entered by him and the possibility of correcting any errors.

4. After the transmission and receipt of the order, we will send the customer an email confirming receipt of the order and summarizing the order details with the possibility of changing the shipping address within 30 minutes of the order confirmation. This confirmation does not correspond to an acceptance of the customer's offer but is only information.

5. The sales contract between the customer and amevista.com is concluded with the acceptance of the offer by us which in turn occurs at the same time as the shipment of the goods. The shipment will be made against advance payment.

6. Amevista.com may refuse an offer from the customer without stating the reasons.

§ 3 Terms of withdrawal

RIGHT OF RETURN

The customer may exercise the right to withdraw from the contract, at his own expense, within 30 calendar days following the date of delivery of the goods.

The cancellation period for the contract is 30 days from the moment in which the customer or a third party nominated by him (excluding the carrier/courier) has taken possession of the goods.

To exercise the right of return, the customer is required, within the terms indicated, to inform Amevista by starting the return procedure in the Personal Area, "Orders" section. Those who have made the purchase in "guest" mode, must first register on the Amevista site with the email address used when concluding the contract and carry out the order reconciliation procedure.

It is mandatory to accompany the package with the forms sent to the customer at the end of the return procedure and therefore present in the Personal Area, "Returns" section; each form must be inserted inside and outside the box, according to the instructions on the sheets.

The integrity of the returned products unused, with their original labels and in their original boxes with the order reference number inside, is an essential condition for exercising the right of withdrawal or cancellation.

IMPLICATIONS OF RESTITUTION

When the customer withdraws from the contract, Amevista is obliged to refund within a limit of 14 calendar days from the date of receipt of the package at the Amevista warehouse.

The refund will be made using the same payment method chosen by the customer, unless otherwise agreed . The credit will be visible within 10 working days, depending on the refund times established by the card issuing institution.

Amevista reserves the right to block the refund of the amount until the goods have been returned.

The goods must be returned to Amevista immediately and no later than 30 days from the date of notification of withdrawal from the contract.

Amevista uses a special transparent tamper-proof envelope that shows clear signs of tampering in the event of theft or attempted theft. Therefore, if the shipping envelope appears damaged or tampered with, the customer must refuse delivery.

If the burglar-proof envelope is found to be intact, the customer will still have 5 days from the delivery date shown on the courier's website to notify Amevista of any damage; otherwise, the report cannot be accepted.

Even in the case of multiple orders (an order with at least two glasses), each individual item returned to Amevista must be shipped at the customer's expense, separately from the others, each with its own shipping tracking. If the products are returned in a single box or in different boxes but with a single shipment ( multi-package ), 10 EUR will be retained for each individual item returned, directly from the payment method used during the purchase.

If the customer has paid for the entire order using a Gift Voucher, the amount will be refunded with another Gift Voucher to be used for his/her next orders.

If the customer paid for their order by combining a Gift Card with a different payment method, in the event of a return, the refund will be made to the other payment method selected when paying for the order. For example, if the customer used a credit card and a Gift Card, the refund will be made to their credit card and the Gift Card will be used for the items they kept. If the amount of the Gift Card is greater than the amount used with the other payment method, the refund will be made to the Gift Card.

EXCLUSION CRITERIA FROM THE RIGHT OF WITHDRAWAL

The right of withdrawal is applicable only if the products have not been customized (frames with graduated and/or colored lenses), modified, damaged or deprived of the quality seal applied to the glasses. The cost of customized products cannot be refunded because these are custom-made items created according to the customer's specific needs and measurements. The customization of the products, therefore, excludes the possibility of withdrawal.

§ 4 Voluntary right of return

1. In addition to the statutory right of withdrawal, Amevista offers the following voluntary right of return option: all products on Amevista.com can be returned within 30 days of receiving the goods. The right of return applies exclusively to items in perfect condition, unworn, and with the label and quality seal. Any damage to the goods due to use or other traces of use, including removal of the safety label, removal/damage to the packaging, accessories or similar, will result in the loss of the right of return, as the item is no longer considered suitable for sale. In this case, the customer must arrange for the goods to be collected from the Amevista warehouse, informing Amevista in advance that they will be returned to the customer without the possibility of a refund.

2. Return shipping

2.1: Shipping and return costs

Amevista carries out a quality control of the product before shipping the glasses. In the event of a damaged or defective product, the customer must notify Customer Service within 5 calendar days of receiving the order, providing all the information requested. After careful verification and confirmation by Amevista, we will proceed with the collection of the goods and the sending of a replacement item. In this case, the cost and booking of the collection will be borne by Amevista; the free nature of the same will not be guaranteed if you choose to only return the goods. In the event of collection of the goods, the customer cannot deposit them at a fermopoint .

Any shipping costs paid for delivery will not be refunded in case of refusal of the goods.

Please note that we only accept returns from the same country as the delivery. If the delivery was made e.g. in Germany, the return must also come from Germany.

In case of return, the amount will be sent to the payment method used at the time of purchase; any losses due to exchange rate fluctuations will not be refunded.

2.2. Please send the goods to be returned to the following address: Amevista Srl - Via Flaminia, 844 – 00191 Rome, Italy. Returns received at different addresses will not be taken into consideration.

2.3. Please note that orders for customized products cannot be cancelled. Additionally, products that are personalized in any way or otherwise made to measure, according to the customer's specific instructions, cannot be returned for returns or refunds. This includes, but is not limited to, customized eyeglasses, prescription eyeglasses, or eyeglasses that have been altered from their original condition.

§ 5 Prices, product presentation, availability and Gift Cards and promotional codes

www.amevista.com apply . Any shipping costs are indicated at the time of the cart in the specific section.

2. The products offered on the amevista.com website comply with EEC regulations , contact lenses comply with the provisions and fundamental safety requirements imposed on the manufacturer by directives 93/42/EEC, 90/385/EEC and 98/79/EEC on medical devices, guaranteeing the originality of the original products. All products are presented using digital photographs of actual products (slight variations between these photographs and reality do not constitute defects of conformity). The products are not manipulated in any way by Amevista and are shipped with original labels and packaging (if available, certificates of originality are also sent).

3. Gift Card (hereinafter referred to as "Card")

1. The Card is valid for the purchase of items on sale on the Amevista.com website. During the purchase process, the recipient must enter the code associated with the Card in the cart.

2. The Card can be purchased using the payment methods accepted on the Amevista.com website. The Card cannot be purchased using another Gift Card.

3. The Card can be used in a single solution for purchases of an amount equal to or greater than the value of the Card itself. The amount contained therein is to be considered VAT included.
4. Where applicable, the refund for items purchased using the Card and returned will be made through a Voucher that will be sent by email to the address indicated by the customer who made the purchase using the Card, for the return of products purchased online. The voucher will be subject to these general conditions of use, where applicable.

5. The Card will be valid for 1 year from the date of purchase of the virtual Card. Upon expiration of its validity, the Card cannot be renewed or used to purchase items and the residual value of the Card cannot be refunded or converted into money.

6. The Card is not nominative and can be used by anyone who presents it to purchase items. The Card holder is solely responsible for the use and custody of the Card.

7. For virtual Cards purchased, Amevista will not be responsible for the failure to receive or delay in receiving said virtual Card by the recipient due to force majeure and in any case not attributable in any way and to the maximum extent permitted by current legislation to Amevista such as, by way of example and not limited to: (i) the inaccuracy of the data of the recipient of the virtual Card provided by the purchaser of the Card itself, (ii) the circumstance that the email sent by Amevista is considered spam or junk mail.

8. Cards obtained by any fraudulent or illegal means will be considered null and void, cannot be used to purchase items and the purchase price cannot be refunded. Amevista reserves the right to cancel or suspend the Card in the event of suspected fraud.

9. The Card may not be used for advertising or promotional purposes of products or services marketed by third parties external to the entity issuing the Card, unless previously authorised by the latter.

1 0. The purchase and/or use of the Card entails full acceptance of these general conditions, which were made available to the customer at the time of purchase of the Card itself.

1 1. The Card merely allows a payment method and is not intended in any way as an investment instrument and/or a solicitation for savings.

§ 6 Supply of eyeglasses

In relation to any order for the supply of goods where the goods include any item manufactured in accordance with a prescription from a qualified registered medical practitioner or optometrist ("Prescription Order"), the customer warrants, undertakes and represents:

2.1 that you are at least 18 years of age and that you have the legal right, capacity and authority to enter into these Terms of Use;

2.1.2 provide any details reasonably requested by Amevista to confirm that you are eligible to purchase the products;

2.1.3 that you are acting in your capacity as an individual consumer and that the products or any part of the products will not be used for resale or for any purpose other than your personal use, except as set out in Section 2.2 below;

2.1.4 that you are the authorised holder of any credit/debit card that you may use on the site;

2.1.5 your order submission and your use of the products comply or will comply with all applicable laws;

2.1.6 In relation to any order for "progressive" glasses, you are ordering such glasses for your own personal use and not on behalf of any other person.

2.2 Except as set forth in Section 2.1.6, a parent and/or legal guardian may place an Order for his or her minor child (a "Minor"). In connection with such Order;

2.2.1 “You” (and its derivatives) will be deemed to include the Minor for the purposes of the Terms and Conditions;      

2.2.2 It is the obligation of such parent and/or legal guardian to ensure that the Minor complies with these Terms and Conditions and complies with all laws applicable to the Minor's use of the products.

§ 7 Storage of the contract text

The data concerning the order are stored. If the customer requests a copy of the order, he can print the "Confirmation of receipt of the order" that appears on the screen after having sent us the order by clicking on the " Confirm order" and after the positive verification of the payment.

The customer will receive an e-mail confirmation of the order placed containing all the data entered.

§ 8 Delivery and shipping

1. Amevista entrusts its shipments to the couriers DHL, Bartolini, Dpd , Chronopost , Seur .

2. The goods are ready for shipment within the day following the customer's order, with the exception of products not in stock. Unless otherwise specified, delivery will be made from 1 to 6 working days to the address indicated at the time of ordering, depending on the shipping method selected and the country of destination.

3. The different shipping options available will be displayed at checkout.

4. Producing prescription, customized or specially treated lenses (see the blue light filter) requires up to 6 days, which are added to the shipping time of the frame. If the customer chooses to send or upload the prescription to their Personal Area after completing the order, additional days will be required.

4. When the goods are ready and shipped, the customer will receive an order confirmation email in which he will find the link to view the shipping details.

3. Shipping to countries outside the EU

3a) Shipping to United Kingdom and Switzerland

Experience shows that delivery times for Switzerland/Uk are 1 to 5 working days. Please note that we cover the insurance of the goods as well as all costs for accompanying documents. The prices of the products indicated include the value added tax valid in Switzerland/Uk as well as customs duties and processing fees. In the event that the return instructions are not followed correctly or if the provided documents are not used, customs may apply import taxes. These taxes will be borne by the customer and deducted from the refund amount.

Import duties are not applicable if the order comes from an EU country.

Amevista cannot accept responsibility for customs clearance delays or failed payments, although we will try to keep any delays to a minimum.

§ 9 Payment, default, legal offsetting and right of retention

2. Transaction security

PSD2 is a European regulation that makes online payments more secure. When you place an order online using a payment card, your bank may ask you to confirm your identity through 3D Secure authentication. There are several ways to authenticate online payments and you may be asked to confirm your identity via SMS, email or TouchID . Once your payment has been authenticated, your order will be placed and you will be returned to the order confirmation page. As soon as your order is confirmed, you will receive an email.

3 . Payment via Gift Card

2.1 To pay by Gift Card, you must enter the Gift Card code in the designated field and then click on the "use code" option (ordering stage, "go to cart"). If the value of the order is greater than the value of the Gift Card, you must choose a payment method to pay the rest of the amount. The conversion of the value of the Gift Card into cash is excluded.
 
4. Payment via promotional code

4.1 To pay using a promotional code, you must enter it in the designated field and then click on the "use code" option (ordering stage, "go to cart"). If the value of the order is greater than the value of the promotional code, you must choose a payment method to pay the rest of the amount.

§ 9 Retention of title

Amevista will remain the owner of the goods supplied until full payment of the entire amount.

§ 10 Questions about orders and complaints

§ 11 Guarantees

Amevista guarantees full traceability of purchase of all products and certifies their exclusive origin directly from official suppliers.

All products are guaranteed for 24 months from the date of purchase against any manufacturing defect. Damage caused by improper use of the product, including deterioration or wear and tear, is not guaranteed. The warranty covers all possible manufacturing defects and does not cover any breakages due to misuse or poor maintenance and/or accidental damage by the consumer. Scratches or lines on the lenses are considered normal wear and tear and are not covered by the warranty, unless it is demonstrated that the product had such defects upon delivery. Please note that Amevista is not responsible for direct or indirect damage to people or things resulting from the malfunction of the products.

What does the warranty cover :

- Missing components

- Delamination of the coating of sunglasses lenses

- Bubbles or imperfections in the lens coating

- Flaking or deterioration of the mount

- Welding defects

What the warranty does not cover :

- Rod misalignment

- Normal wear (scratches)

- Damage caused by accident, negligence, shock, improper use or incorrect storage and/or maintenance of the product

- Damage caused by chemicals

- Unauthorized modifications or repairs

What to do if you find a lack of conformity

In the event that the Consumer finds a lack of conformity, he/she must contact our Customer Service operators in the “Assistance” section on the Amevista.com website.
